Legal Responsibility for Professional Actions

The Introduction

Responsibility is the penalty for breaching a moral or legal obligation incumbent upon an individual within their community. By its very nature, responsibility is moral when it pertains to a breach of a moral or ethical obligation, and legal when it pertains to a breach of a legal obligation. Actions that give rise to responsibility, whether committed by any member of society or by a professional in their relationship with the consumer of their services, are also considered professional. We define a professional as anyone belonging to a liberal profession. Liberal professions are those practiced by professionals through a range of activities carried out independently, providing the necessary technical and practical training. Consequently, professional responsibility has multiple legal dimensions, stemming from the multiplicity of its causes. This is the impetus behind this forum, as it remains a subject of jurisprudential debate, and it arises from the importance of our modern life, characterized by the evolution of legal relationships and the increasing number of imposed obligations. This importance has been amplified by the rise in errors committed by professionals, whose professional mistakes often result in harm, thus paving the way for a proliferation of claims for liability for professional errors.
